BT Utility trench failing that crosses the A6003

Sent to Rutland County Council 3 minutes later. FixMyStreet ref: 1336780.
BT Utility trench failing / collapsing that crosses the A6003 at church lane. Has been repaired twice over the last two years. Failure causes small ramp in the road that causes houses to shake when HGVS pass. Cracks are also appearing in road around reinstatement.

6 weeks since report still no repair.
RCC claim that repair not necessary. Replied advising that on 19th march (following my initial report of fault) I was advised by a representative of RCC that "I was out last week and spotted the material coming out and I have issued a defect to BT". I do not understand how this issue was recognised as a defect in March but is now not seen as a problem 4 months later!!! I do not consider this matter to be closed.

8 weeks since report and still nothing done. Situation becoming worse. I fear that severe damage is being done to my property (cracks appearing on internal walls.....

15 weeks since report and still no action has been taken. Due to this inaction my home is now an unpleasant place to be at any time of day due to the constant shaking caused by HGVs passing the defect in both directions. This is unacceptable...

23 weeks since report and still no repair. Advised on 1st October that BT had agreed that an area of the reinstatement needed replacing and that it would be done by them shortly.....

6 Months since initial report on "fix my street" and apart from a fading yellow line painted around the defect nothing has been done to rectify the issue. How much longer do we need to wait until this defect is repaired?

30 Weeks and still no work carried out to repair this defect. How much longer does our quality of life have to suffer or are we going for a new county record???

According to the RCC website "If you wish to report a problem in your area then please click the 'Report via FixMyStreet' button which will allow you to report a range of issues in the Rutland area" This was done June 2018. I am now being advised "Unfortunately the trench is the responsibility of BT and you would need to contact them". Can I ask why I need to contact BT to discuss Rutland Highways??? I was advised that a defect was issued to BT by a member of the highways department in March 2018 following my initial report of the fault. Will somebody please take responsibility for the rectification of this defect!!! If Rutland Highways do not want to take responsibility then please advise all details regarding the defect notice issued to BT in March 2018 a.s.a.p and I will do it myself….

Our Streetworks Co-Ordinator has been out to review this location in detail and what was found was that the trench is within the specified limit for the size of the reinstatement, in accordance with the New Roads and Streetworks Act 1991, Specification for the Reinstatement of Opening in Highways .
What he picked up was a maximum depression of 15mm on the northbound side at the kerb edge only, the rest of the reinstatement is level.
He also travels this route on a daily basis, and will continue to monitor any deterioration.

Once again this matter is not fixed! please read through the whole history of this report before sending a generic and unacceptable response!!!!
I have an email dated 19/03/2018 from RCC Network & Streetworks Co-Ordinator advising
“I was out last week and spotted the material coming out and I have issued a defect to BT (not the only one) so they should be back out in due course, they don’t seem to learn from their mistakes even when it hits both the guys on the ground but also the contractor in their pockets. But I will keep charging them until they get it right.”
Followed by and email dated 08/08/2018
“Just to let you know that I have emailed BT to ask for a site meeting to try to resolve this issue. I will let you know when that will be and if you are around you will be more than welcome to attend if not one of us will get back in touch with you with the outcome.”
No invitation to attend this site meeting was received. However on 01/10/2018 I received a further email advising:
“On Friday I visited the site with BT we were both agreed that the trench is within tolerance, but there is an area by the kerbs ( that is marked in white paint) that needs replacing and will be reinstated by them shortly”
Todays email advises advises a depression of 15mm on the northbound side at the kerb edge. Strangely no mention of the obvious fracturing of the road surface that has developed over the last few months suggesting a larger problem surrounding this reinstatement.
If your co-ordinator travels this route daily they will also feel this reinstatement as they drive over it. However, you fail to mention this.
As stated previously every HGV that passes over this reinstatement causes my home to shake!!!!
As we approach 45 weeks since this was reported, once again RCC seem to be making it up as they go along while my quality of life and that of my neighbours continues to be negatively affected by the lack of action regarding this reinstatement. When will Rutland county council take responsibility for its highways?
Once again this matter is NOT closed until rectification is performed.
While we are waiting for this to happen could you please advise the sections of the New Roads and Streetworks Act 1991, Specification for the Reinstatement of Opening in Highways that relate to this size of reinstatement. Also as there has not been a revision of this site April 2010 could you please advise how Rutland Network and street works co-ordinator failed to mention this in any emails since March 2018?
As a freedom of information request I will be asking for the current amount RCC have charged BT for this reinstatements failure (as stated in the email dated 19/03/2018.
Finally I do not do this for fun.I have far better things to do with my time! This is a problem caused by faulty reinstatement of roadworks performed by BT on Rutlands Highways that requires immediate rectification. The time for trying to avoid this over, the time for action is NOW!

1 year and 1 week since the initial report of this defect and various admissions by RCC Highways that there is a problem followed by two attempts to advise there is not and the inevitable pothole is beginning to appear on the reinstatement. This issue needs to be rectified immediately as if this pothole develops my home and the homes of my neighbours will become uninhabitable due to the vibrations that the high volume and weight of traffic that use this road will cause.
Will somebody please take immediate responsibility to rectify this situation?
