Shrubs/plants overgrowing the footpath

Sent to Rutland County Council less than a minute later. FixMyStreet ref: 9475628.

We note as attached the public footpath in front of 10 Church Street extends to the front of the property. As per the photos attached the owners have planted shrubs and let them overgrow onto the narrowed down footpath so there is no longer a width of path to walk on. We note there is no legal stipulation as to the minimum width of footpath but either the plants need removing so they do not keep overgrowing or the front raised wall off the old footpath is set back a little. I have approached the owner to cut back the shrubs but he has refused. It is a health and safety issue as I was recently walking down the footpath with my dog as another barking dog was on the footpath on other side of the road and had to step into the road to get past the shrubs just as a vehicle was coming down Church Street in the opposite direction, resulting in a near miss.

  • EPC have spoken to the house owner who confirmed that RCC had been to look at the area outside their house last year. RCC confirmed that it is not a pavement outside their house as it is too short (approx. 8 inches) and people should not try and use it as such. There is a pavement on the opposite side of the road that walkers can use.

  • If you are going to inspect this again please can you report back to Empingham Parish Council as we have already told you that you inspected the area last year and told the owner that it was not a footpath and should not be used as one. There is a pavement on the opposite side of the road that walkers can use so we are not sure why someone would even try and walk on the side of no.10 Church Street??? Empingham Parish Council
